Terms of Service

The rules governing the use of the WizStatus monitoring service

These Terms of Service (ToS) govern the use of the WizStatus monitoring service. By using our service, you agree to be bound by these terms.

Article 1 - Definitions

  • 1"Service": the WizStatus monitoring platform accessible at wizstatus.com
  • 2"User": any natural or legal person using the Service
  • 3"Account": User's personal space on the Service
  • 4"Monitor": a configured monitoring (Ping, HTTP, SSL, Port, DNS, Email)
  • 5"Subscription": Service usage plan (Free, Starter, Pro, Team, Business)

Article 2 - Purpose of the Service

WizStatus is a monitoring service that allows you to monitor the availability and performance of websites, servers and online services. The Service offers:

Ping Monitoring (availability and latency)
HTTP Monitoring (status, response time, security score)
SSL Monitoring (certificates and expiration)
Port Monitoring (TCP availability)
DNS Monitoring (resolution and records)
Email Monitoring (SPF, DKIM, DMARC, blacklists)
Multi-channel Alerts (Email, Slack, Discord, Telegram, Microsoft Teams, Webhooks)
Automatic subdomain and service discovery

Article 3 - Registration and Account

3.1 Account creation

Access to the Service requires account creation. The User agrees to:

  • Provide accurate and up-to-date information
  • Maintain the confidentiality of their credentials
  • Immediately notify any unauthorized access

3.2 Eligibility

The Service is accessible to adults capable of contracting. For legal entities, the representative must have the authority to bind the entity.

Article 4 - Subscriptions and Pricing

4.2 Billing

  • Subscriptions are billed monthly or annually based on User's choice
  • Payments are processed by our provider LemonSqueezy
  • Prices are shown in EUR including VAT
  • Annual subscriptions receive a discount (usually 2 months free)

4.3 Plan changes

Users can change plans at any time from their dashboard. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of the current billing period.

Article 5 - Service Usage

5.1 Permitted uses

  • Monitor your own sites and services
  • Monitor sites/services with authorization
  • Create public status pages

5.2 Prohibited uses

  • Illegal activities
  • Unauthorized monitoring
  • Overloading or disrupting the Service
  • Circumventing limits
  • DDoS or similar attacks

Article 6 - Service Availability

6.1 Availability commitment

Monthly SLA guaranteed

This availability excludes scheduled maintenance (announced 48 hours in advance), force majeure events, and issues related to third parties.

6.2 Maintenance

Scheduled maintenance is preferably performed outside business hours (Europe/Paris). Users are notified by email and via the status page.

Article 7 - Data and Intellectual Property

7.1 User Data

The User retains ownership of their data. WizStatus has a limited license to process this data in the context of Service delivery.

7.2 Data Protection

The processing of personal data is governed by our Privacy Policy.

7.3 WizStatus Intellectual Property

The Service, its design, features and code are the exclusive property of WizStatus. No intellectual property rights are transferred to the User.

Article 8 - Termination

8.1 Termination by User

The User may cancel their subscription at any time from their personal space. Cancellation takes effect at the end of the current billing period. No pro-rata refund is made.

8.2 Termination by WizStatus

WizStatus may terminate an account in case of:

  • Violation of these Terms
  • Non-payment after reminders
  • Fraudulent or illegal activity
  • Extended inactivity (more than 12 months for free accounts)

8.3 Effects of termination

Upon termination, access to the Service is immediately suspended. Data is kept for 30 days then permanently deleted. The User may request data export before deletion.

Article 9 - Limitation of Liability

9.1 Exclusions

WizStatus cannot be held liable for:

  • Indirect damages (loss of revenue, data loss, etc.)
  • Unavailability of monitored sites/services
  • Notification delays or failures due to third parties
  • The use made by the User of the information provided

9.2 Liability cap

In any event, WizStatus's total liability is limited to the amounts paid by the User in the past 12 months.

Article 10 - Modifications to Terms

WizStatus reserves the right to modify these Terms at any time. Modifications will be notified by email and/or displayed on the Service at least 30 days before taking effect.

Continued use of the Service after the modifications take effect constitutes acceptance of the new Terms.

Article 11 - Applicable Law and Jurisdiction

These Terms are governed by French law.

In case of dispute, the parties agree to seek an amicable solution. Failing agreement, French courts shall have exclusive jurisdiction.

Consumers may also resort to consumer mediation in accordance with Articles L.611-1 and following of the French Consumer Code.
